O Public Prosecutor (MP) filed the inquiry opened last June following complaints received against the influence of João Barbosa, better known as Numeiro, for hate speech against women in a publication on abortion.

 

According to News Journal (JN), prosecutor Jorge Barbosa Teixeira considered that the phrase “I wasn’t even totally anti-abortion, but after this shit* all I realized is that you [women] are just put*s that want to take on con* without consequence. Abortion is not contraceptive” is “polémic”, “possibly unpleasant”, but it is not a crime.

For the MP, Numeiro's statement is protected by freedom of expression, so there is no crime.

“The opinion, however unpleasant, of the influencer, on some motivations for the voluntary interruption of pregnancy, does not integrate the practice of the said crime”, reads in the filing order, according to the morning.

The prosecutor showed that Numeiro “did not fund any organization, nor did he participate in organization” and argued that it is not “apology, denial or gross banalization of crimes of genocide, war or against peace and humanity”.

“ The defendant merely expressed his opinion, controversial, possibly unpleasant, but not a crime,” the magistrate concluded, adding that freedom of expression is an “essential element of democracy”.

The MP refused the idea of there being crimes of injury or defamation in Numeiro's statement, considering that "the writing was not addressed to anyone in concrete.".

More than a hundred complaints

There are more than a hundred complaints received against a digital content creator by disclosures that “seriously disregard women’s rights and spread misinformation on abortion”.

One of the complaints against Numeiro due to the “polemic” sentence was put forward by the Commission for Citizenship and Gender Equality (CCIG). As far as we're concerned, this won't appeal to the DA's decision.

The “polemic” freedom of expression

In the early hours of May 31, 2025, Numeiro, who has about a million followers on social networks, made a publication on the X, however eliminated by the platform, in which he accuses women of resorting to abortion as a method of contraception.

The statement emerged following the reactions and processes that the anti-abortion announcement, funded by the entrepreneur Miguel Milhão, began to be broadcast on TVI, CNN Portugal, CMTV and News Now. 

The video, entitled “Thank you, Mother”, generated about 9500 participations with the Regulating Body for Social Communication (ERC), which eventually considered that the broadcast of the same by the channels “violated the Television Law and the Advertising Code”.

This is far from the only controversy Numeiro has ever been involved in. A month earlier, in April 2025, the creator of digital content had said that “a woman who dates does not go out at night.”

Other controversies

In 2023, the Portuguese Association of Online Gambling and Gambling (APAJO) filed a criminal complaint against youtuber due to the disclosure of an illegal gambling site. The case, according to JN, is still “in investigation”.

In the same year, Numeiro announced the Ferrari draw among those who bought a €9.99 ticket to watch an online boxing match of his. Days later, he canceled the advertising contest, claiming a computer attack and had to return the money to the buyers.

In May of this year, the influencer revealed that he was going to sue the former competitor of the reality show “Secret story”, Diogo Maia, because, according to him, he broke contract rules related to a fight held at the Super Bock Arena in Porto.

The fight lasted only 30 seconds, once Diogo Maia’s coach threw the towel into the ring, dictating the immediate withdrawal of his ‘athlete’. The moment caused confusion, booing and revolt in the arena.
