O lindsay Clancy's lawyer, Kevin Reddington, criticized one of the 12 jurors who is deciding the future of his client, claiming that he was not following the instructions given by the judge – and demanded that this jury member be replaced.
Reddington said this Thursday that the jury in question “refuses to listen to the law” and accused this unidentified person of “disrespecting the instructions of the court”.
The judge, William Sullivan, gave instructions, however, for the group to return to deliberations, which have been being held since Thursday of last week. Before Clancy’s lawyer even made these demands – already without the group present – the judge read the instructions again – here, yes, with the members of the jury present.
The case is ‘moving’ not only with the United States, but also with several countries in the world. The death of the three children of Clancy – Cora, 5 years old, Dawson, 3 years old, and Callan, 8 months old. The children died strangled in January 2023, and then the mother jumped out a window in an apparent attempt to take her own life. The woman survived and became paraplegic.
What if there's no unanimity?
On Wednesday, it was known that the jury was at a standstill regarding the final decision. According to the U.S. press, it was the first time the jury made public to be at a standstill at this stage.
More than 80 people witnessed in this trial, which took place for six weeks, with the chances for this woman being the conviction for manslaughter (possibility introduced more recently), first degree murder or second degree murder. There is also the possibility that Clancy is not found guilty for reasons of mental health. In this case, the woman will be admitted.
According to the Associated Press (AP), if they fail to reach a unanimous decision, the nullity of the trial can be declared and the case will essentially return to the same state in which it was before the trial, with the former nurse of obstetrics, 36 years old, accused of murder and hospitalized in a psychiatric hospital, awaiting the resolution of criminal proceedings.
In this case, Clancy is likely to be tried again and, in this case, the prosecutors will decide whether to try again with a new jury. If they do, the jury selection process will resume and a new trial session will be scheduled.
According to attorney Brad Bailey, heard from AP, prosecutors could also propose a plea deal to Clancy, that is, defense and prosecution may come to an agreement to avoid a second trial.
Case may fall and not be judged
There is also the option, although less likely, that the prosecution decide not to take the case to a new trial, explains
“ Sometimes, they decide not to proceed, due to the feeling that the result can be the same in all attempts, and also because of the costs involved in the process, especially when there are experts involved”, says the same defense professional to AFP. “These cases will be very expensive.”
This situation may interest Lindsay’s lawyer who may claim that there is no reason to force Lindsay into a new trial, since “he is suffering from the whole situation.”.
Note that in the event of being found criminally responsible for the crime, Lindsay may be sentenced to life imprisonment. If she's acquitted, she could lead to hospitalization in a mental health facility.
