O Penafiel Criminal Instruction Court decided to bring to trial a former mayor for alleged favor, between 2014 and 2020, to a commercial company, receiving in exchange, namely, 18 tickets for football games.
According to a statement published today on the website of the Regional Attorney General of Porto, the defendant would consider that that society and its legal representative “could be useful in organizing the publicity of the campaign of his candidacy for local elections that would take place on 26 September 2021”.
The note does not reveal the name of the defendant, who was pronounced by the practice of crimes of prevarication and undue receipt of advantage, maintaining the factuality and their legal qualification that were imputed to him in the prosecution given by the prosecutor.
The investigating judge considered sufficiently indicted that, between 2014 and 2020, the defendant “in violation of the legal licensing regime for advertising, without prior hearing of municipal technical services and entities outside the municipality whose opinion was mandatory, granted several requests for advertising licensing in favour of a commercial company, with the intention of favouring that company and its legal representative”.
“ The defendant would develop that activity because he knew that that society and its legal representative could be useful in organizing the publicity of the campaign of his candidacy for local elections that would take place on 26 September 2021 ", adds the note.
In addition, it was also considered indicted that the defendant, between 2018 and 2020, received, by the legal representative of that society, 18 tickets to attend football games and attend the box that he owned at the stadium of a football club, “well knowing that those tickets were only given to him because he was the decision maker of those licensing applications.”.
The prosecutor requested a declaration of loss in favor of the State of the amount of EUR 4,788, corresponding to the value of those tickets, “the defendant should be convicted in his payment, for corresponding to the advantage obtained with his criminal activity”.
