Hthe new rules for construction and rehabilitation due to the entry into force of the new Legal Regime of Urbanization and Edification (RJUE), reminded the government, on Monday, through a shared publication on social networks.
“From now on, building and rehabilitating becomes simpler, faster and predictable, with the entry into force of the new legal regime of urbanization and edification (RJUE)”, can be read in the publication of the Government on social network Instagram.
The Executive explains that the “new RJEU clarifies concepts, reduces bureaucracy and successive requests for elements, shortens deadlines, speeds up the issuing of opinions, simplifies procedures for public housing projects and controlled costs and strengthens legal certainty”.
More: “The new rules ensure simplification of procedures, in a framework of investment security and protection of public and private interests, aligning with the urgency of increasing housing supply in the country.”.
What changes, anyway?
The Government underlines in the same publication the following amendments, divided into seven themes:
Legal Scheme for Urbanisation and Building
- Faster, more predictable and safer urban processes
- Less bureaucracy to build and rehabilitate
- More suitable scheme for housing and investment needs
Simpler and more effective processes
- Urban title in hand on the first day
- Quick, clear and predictable prior communication: communicates, pays, informs and executes.
- Lower dependency on administration response
- Uniform procedures throughout the country
Simplified opinions
- Opinions on the basis of the activity delivered by the citizen
- 20-day deadline for issue
- Lack of sounding does not block the progress of the work
More consistent deadlines
- New licensing deadlines: about 70 days for construction works and 50 days for urbanization
- Less successive requests for items
- Initial verification of enhanced procedures for faster processing
- Request more complete Prior Information, ensuring quality in execution
Incentives for public housing and controlled costs (HCC)
- Changes to simpler allotment licenses when 10% are HCC
- Less lending areas if there are HCC lots or affordable private promotion lease
- Strengthening the role of cooperatives in housing promotion
- Extension of licence and communication exemption prior to urban operations for the public interest
Increased control and security
- Clearer and more coherent urban concepts
- Increased legal certainty in urban securities
- Successive control reduced to 1 year
- Reduction to 3 years of deadline for declaration of invalidity
- Appeal to voluntary arbitration extended to acts and opinions of the RJEU
- End of automatic embargo on works
More digital and integrated administration
- Compulsory interoperability
- Municipal platforms compatible with Licencia
- Unique vision of the process for citizens and businesses
- More real-time transparency and monitoring
