ANDmilio Cortés, specialist in criminal law, granted, this Wednesday, an extensive interview to the program ‘El Partidazo‘, issued by Spanish radio Cadena COPE, in which it explained the potential consequences that Jesús Owono will have to deal with, following the violent shock that led to the death of Jesús de Miguel, at the meeting last Monday, between Tenerife and FC Andorra.

“ In principle, it would be a negligent offense, and that is a much more complex category than the intent. Neglect consists in producing a harmful result – in this case, a result of death – without wanting to produce it, because it was not the intention, but carrying out a conduct that carries out with it such an amount of danger to the physical integrity of the action itself that ends up producing the result of death ", clarified.

“ This happens on the treadmills, when, distractedly, we ignore them and cause a result of death, or when we suffer intoxication in a restaurant, for example. Neglect is a category that coexists with us, in criminal law, but it is, of course, more difficult to prove than a direct intent, which reveals more clearly the intention of the author ", continued.

“ I have no doubt that this is negligence, but in the Penal Code, negligent murder distinguishes between a serious negligence, which leads to up to four years in prison, and a lead, which carries a penalty of fine. Since we cannot make a special sports criminal law, we have to apply the imputation titles, and we only have these two, to objectively analyze this conduct ", completed.

The jurist also stressed that it will be “fundamental” to realize for sure “what was the mechanic of the performance of the doorman”, at the time of sentence him: “There is a fact that, if there is finally a judicial resolution, it will weigh heavily, that is, the advanced one did not see the goalkeeper, but the goalkeeper saw the advanced one.”.

National Police is already investigating the case

The Homicide Group of the Spanish National Police, remember, has already ordered the opening of a formal investigation to the death of Jesús de Miguel, in order to understand for sure the contours of the bid already recorded during the compensation period of this meeting, which would end up being suspended by the referee Manuel Pérez, so the remaining minutes will be played on a date yet to be defined.

The advance (which, just over half an hour earlier, had been thrown to the captain's seat, Enric Gallego) ran loose for the attack, behind a ball thrown in depth, when it was authentically hit by the opposing goalkeeper, in midfield, and fell helpless on the lawn, before losing consciousness, which caused moments of deep consternation.

Elements of both formations immediately requested the entry of the medical team, which watched him for a long minutes before being transported by ambulance to the so-called hospital unit. Jesús Owono was expelled and abandoned the lawn without the slightest protest, when he came across the urgency of the opponent's state and turned to see what was going on.
