Abandoned baby parents in Malaga sentenced to 7 years in prison

The parents of a newborn baby abandoned at a train station in Malaga were sentenced to seven years in prison for attempted murder. The court considered that the couple left the child out in the open, knowing that abandonment could cost him his life, without triggering the help.

Othe parents of a newborn baby abandoned by a railway station in Malaga, southern Spain, were sentenced to seven years in prison each for the crime of attempted murder.

 

The case dates back to October 2023 and the court gave as proof that, on the day of abandonment, the couple had arranged to meet to attend a sporting event in Malaga. That same night, the woman ended up giving birth, and soon afterwards, she left the newborn in a concrete platform.

According to the sentence quoted by the Europa Press news agency, “the abandonment was carried out exclusively by the defendant, who covered the baby with a towel and a kind of hoodie,” leaving it in the vicinity of Victoria Kent Station. 

It was further proven that neither the mother nor the father contacted the emergency services, nor asked for help from anyone who could be in the place where they abandoned the baby. 

Two hours after the murder, the defendants took a train to Fuengirola and then moved on to the man's house, where they remained until the next day. The next day, the woman returned to Córdoba, where she lived. 

The mother only found out later, through news on social network Facebook, that the girl had not died and had been found alive the morning after abandonment.

Although the woman abandoned the child, the sentence stressed that the man did not take any action to prevent her. 

“ It is clear that the consistent behavior in abandoning the newborn implied the representation that she could lose her life ", said the sentence. “However, neither one of them cared to assume that eventuality.”.

The court also considered “indifferent” that the defendant knew whether or not she was pregnant, or that the defendant claimed not to have noticed any symptoms of pregnancy.

Furthermore, there were also contradictions between the statements of the two defendants. While the woman claimed, in response to her lawyer, that she thought the baby was dead, because she did not cry or had her eyes open, the man declared that the woman had breastfed the child.

The man denied, throughout the legal process, to be the father of the child.

According to judicial sources cited by Europa Press, the trial took place in February, but the sentence is not yet final, since the defendants appealed and the appeals continue to be processed.

In addition to the prison sentence, each of the defendants was sentenced to the prohibition of approaching the victim for ten years, freedom watched for ten years, after the sentence of imprisonment and loss of parental power over the child, in the case of the mother and also the father, if it is confirmed that he is effectively the parent.
