“ A Permanent Political Commission has already asked the CPN Bureau to convene a meeting of the National Political Commission, to be held later this month, to examine in detail the content of the judgment and to discuss the following steps”, reads a clarification addressed to the PAN militants, to which the Lusa agency had access.
The PAN assures its members that “the process will be conducted with responsibility, respect for the judicial decision, the Statute of the PAN and the internal democratic functioning of the party”.
In this internal document, it is worth noting that the decision of the Constitutional Court (TC) “does not correspond to a declaration of nullity of the whole Congress, nor to a decision that removes legitimacy or continuity of functions to the bodies elected in it”, which “continues to perform normally the functions for which they were elected”.
“ The decision focuses on specific rules of regulation used in the Congress and determines that it is up to the PAN bodies themselves to replace the identified procedural biases resulting from this decision ", refers.
“The Court again stated that it is up to the party itself, through its competent bodies, to draw the necessary consequences and restore legality. This is exactly what the PAN will do,” he adds.
In a judgment dated Tuesday, 8 September, the plenary of the Constitutional Court rejected an appeal from the PAN, filed in July, and confirmed the invalidity of the election of the holders of the national organs in the last Congress, including the spokesman, Inês Sousa Real, the only Member of this party.
When announcing the appeal of the first judgment of the TC, the PAN declared “respecting the decisions of democratic institutions” and reaffirmed its “commitment to the legality, transparency and participation of all affiliates and all affiliates”.
The PAN argued at the time that it was “unproportionate the consequence determined by the Constitutional Court, taking into account the concrete circumstances of the case, the time elapsed until the decision and the fact that three previous decisions of the Court itself did not have a suspensive effect on the holding of the Congress or on the taking of office of the national party bodies”.
The initial decision of the Constitutional Court is contained in a judgment dated 13 July following a request by the PAN militant Carolina Pia contesting the election of the members of the party's internal bodies at the X Congress of the PAN, held on December 20, 2025, in Coimbra, in which Inês Sousa Real was re-elected spokesperson.
In that judgment, the Constitutional Court declared illegal part of the regulation of the last Congress of the PAN and, as a consequence, decided to invalidate the election of the holders of national bodies in that Congress.
The TC indicated that it is not for it to “determine the holding of a new Congress, nor condemn the party to the practice of concrete acts” and that it is up to “the competent party bodies to draw the appropriate consequences of this decision and thereby restore legality”.
After the first judgment, the Transform to Grow movement, of internal opposition to the current leadership of the PAN, asked for the resignation of the party's spokesman, Inês Sousa Real, and defended the holding of a new Congress with internal elections.
The Transformar para Crescimento movement is led by Carolina Pia, author of the challenge request that originated from this judgment of the TC, who led the only opposing list in the last elections to the party's leadership and who was absent from this Congress in protest, considering that the "democratic guarantees" to carry out the work were not guaranteed.
