O BCP paid a total of 42.2 million euros by September in compulsory contributions, including those from the banking sector and the Resolution Fund (FdR), today announced the bank's executive president.

“The mandatory contributions recorded in the first nine months of 2025 were EUR 20,4 million and this year EUR 42,2 million,” among the contributions from the banking sector and the resolution fund, said BCP Executive President Miguel Maya, in response to journalists, after presenting the group’s results in Oeiras, Lisbon.

Miguel Maya recalled that in 2025 there was a reversal of the additional solidarity which ran the EUR 30 million.

The Eco reported in July that the Constitutional Court declared unconstitutional the standard that allows Banco de Portugal to set the rates of additional contributions to the Bank Resolution Fund, since this is a competence of the legislative power, in a process driven by a banking institution. The Economic Journal then advanced that it was the BCP.

This is not the initial contribution to the Resolution Fund, as it was defined by government decree-law, but the additional contributions that banks pay annually and are determined by Banco de Portugal.

According to Eco, “in judgment No 666/2026 dated 13 July, the judges of the Ratton Palace concluded that the law could not refer to Banco de Portugal the definition of an essential element of the tax without establishing minimum, maximum or concrete criteria for its determination”.

In such cases, by law, the effect is for the entity that complained and only the same understanding of the Constitutional Court in other cases would lead to the declaration of unconstitutionality with general mandatory force, extending the effects of the decision to all banks that pay contributions.

In addition on the banking sector was what happened in 2025. After several similar decisions of the Court Constitutional in bank-driven cases, additional banking tax rules were declared unconstitutional and the government returned some EUR 200 million to banks (values they had paid in previous years).

The Resolution Fund was set up in 2012 to finance the implementation of resolution measures to banks that would be in difficulty, which would happen to BES and Banif.

One of the financings of the FdR is contributions paid by the banks, the contribution to the banking sector (netted EUR 193.5 million in 2025) and the additional periodic contribution (EUR 59,2 million).

“ There is no victory, but a favorable decision to BCP [...]. The total amount of contributions covered by the Decision, excluding the initial contribution, is EUR 154 million. The decision is not reflected in the accounts ", finished.
