A charlie Kirk's family, the ultraconservative activist who was shot to death last year, must be preparing to sue the University of Utah, where the attack took place on September 10, 2025. For the moment, there is a notification sent to the authorities of the United States and to the educational institution.
According to what CBS News writes this Wednesday, the sent notice reports gaps in security installed at the institution on the day of Kirk's death, who died after a gunman managed to climb one of the rooftops on Orem City campus, and shoot him. The activist's family, a great ally of the President of the United States, Donald Trump, also justifies where the failures occurred. All the warnings and grounds given indicate that a case against the university is on its way.
While the Associated Press (AP) had already advanced, after an analysis, that the campus had not adopted several public safety practices, CBS now points out that family lawyers refer that the kirk’s death was the result of “advanced decisions” that left the 31-year-old activist exposed to the shooter.
According to the publication, the number of agents was much lower than recommended for a campus with the size of Orem. There was also no drone flying over the site to eventually detect a possible intruder – what happened. The event had about 3,000 people, no agents checking suitcases or any metal detector.
“ The risk of a sniper positioned on a roof should have been a primary concern, given the attempted murder of President Trump – close friend and political ally of Charlie Kirk – by a shooter on a roof the previous year,” wrote the lawyer, Loren Washburn, in the notification sent.
The document, which is dated September 9, 2026 – the day before Kirk's death was marked, is by law one of the steps necessary to enter a process of this kind, hence the possibility for the family to proceed with it.
In addition to Utah's status, they are identified in the document the university's then president, Astrid Tuminez – who announced his departure in January this year – and the campus police department, Jeffrey Long. This last officer said that six campus agents coordinated with eight Kirk's private security guards.
The institution confirmed receipt of the notification to CBS News, stating: “We are aware of the notification of claim. The university deals with legal issues in accordance with established processes. Our focus remains on supporting the community of our campus.”.
When asked about it, the Utah Attorney General's Office chose not to comment on a possible lawsuit.
The lawyer also wrote: “Tragically, universities did not take any of these security measures – steps that only they had the authority to take – and resulted in a situation that resulted in a state of defense for Charlie Kirk.” The lawyer pointed out that in addition to the organization failing to ensure the necessary security measures, there were also no operational first aid, which led to the fact that after being shot he was taken to a hospital in a private vehicle, rather than in an ambulance – and duly accompanied by professionals.
The suspect, Tyler Robinson, is charged with crimes that include murder and has not yet declared his guilt or innocence. The 23-year-old defendant turned himself in to the authorities the day after the shooting.
