A measure maintains that the contents affront brazilian legislation and disregard decisions of the Supreme Court (STF) of Brazil.
The notification cites videos with tutorials on “how to create a casino platform” and marketing strategies for the “online game” identified by Agência Lupa, a portal specialized in the coverage of disinformation in Brazil.
The Attorney General of the Union (AGU), a ministry that defends the interests of the Government in judicial proceedings, maintains in the notification the irregularities of Youtube.
“ Although the profiles are entitled as digital marketing companies, they freely propagate the unregulated game and encourage practices that configure criminal offense”, reports the press release.
The agency states that the videos disregard the legal requirement of authorization and certification for the exploitation of bets and offer guidance for illicit activities without alerting users about the restrictions provided for in the legislation.
AGU supports the request in Brazilian legislation, which states that so-called fixed quota bets, popularly called ‘bets’ in the country, can only be exploited by prior authorization from the Ministry of Finance.
The notification also highlights that YouTube Terms of Use itself prohibit content that facilitates access to regulated services irregularly, including uncertified gambling websites.
According to AGU, the continuous circulation of this type of content threatens the integrity of information and consumer protection, as well as being associated with crimes such as tax evasion and money laundering.
The body warns that the possible omission in the removal of the contents may lead to civil liability solidarity of the platform for the damage resulting from the maintenance of materials in the air.
