O attorney General of the Republic (PGR) today challenged the Assembly of the Republic to review the 1974 diploma that regulates the right of demonstration, refusing to request the review of this decree-law to the Constitutional Court (TC).

“ The legislative amendments cannot go as far as concrete facts are concerned. We must mature this situation and I am convinced that the authority responsible for this, which is Parliament, will mature and think about it. [...] It is a competence of the parliament and the parliament should do so”, defended Amadeu Guerra, in the margins of a class on asset recovery, at the Faculty of Law of the New University of Lisbon.

The maximum leader of the Public Prosecutor’s Office also maintained that, “for the time being”, he does not see “in clear terms that it is necessary” to ask the Constitutional Court to monitor the constitutionality of the diploma in question, which has been questioned regarding the camps of the last two weeks in Porto and Lisbon for the right to housing, dispersed with the use of force at dawn by the PSP.
